RENTAL TERMS AND CONDITIONS

This Rental Agreement constitutes a contract between renter, hereinafter referred to as “guest” and Sea Shell Vacation Rentals, Inc. hereinafter referred to as “Agent”. Any monies received by Agent for occupancy of vacation property indicate the acceptance of these Rental Terms & Conditions.  It is the responsibility of the guest to be familiar with all property policies.

“Guest must be 25 years old to rent a unit without a parent or legal guardian”

RESERVATION DEPOSIT: A $500 (Five Hundred dollars and 00/100) RESERVATION DEPOSIT plus a NON-REFUNDABLE ADMINISTRATIVE FEE (based on 3% of the total rental rate) are required. The RESERVATION DEPOSIT will be applied to the rental fee. All reservation deposits are held in a non-interest bearing account. If the Reservation Deposit and/or signed Rental Agreement are not received by our office within 7 days of your reservation date, the reservation may be canceled without notice.  Reservations during High-Season (Feb-April), a 50% deposit of the rental fee and taxes balance is due 60 days prior to arrival date -payment by check is required-. Remaining balance will be due upon arrival.  Reservations during the Off-Season (May-Jan) rental fee balance and taxes are due upon arrival (unless noted differently on your reservation confirmation).

TRIP CANCELLATION INSURANCE (optional): Safeguard your trip with CSA Travel Protection. A Travel Insurance Plan may be purchased from Sea Shell for coverage through CSA. Please click http://www.csatravelprotection.com/certpolicy.do?product=G-330CSA for detailed information.

VACATION RENTAL DAMAGE COVERAGE (optional): Vacation Rental Damage Protection: As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $1,500.00. Any damages that exceed $1,500.00 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $1,500.00. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy here: www.vacationrentalinsurance.com/g20vrd. The Vacation Rental Damage Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directly Sea Shell Vacation Rentals, Inc. any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Sea Shell Vacation Rentals, Inc. directly if you do not wish to participate in this assignment. If you do not wish to purchase the Vacation Rental Damage Protection, a $500 security damage deposit will be required upon check-in.

SECURITY DAMAGE DEPOSIT: Upon arrival a Security damage deposit of $500 paid by Visa, MC or Discover card is required. At the time of check-out, if your rental unit is NOT left in a reasonable and clean condition or in the event of any damages, missing items and/or extra fees are incurred by you or your guests during the rental term, Agent or its assignees will notify the guest for claims within 15 days after departure date. If the damages and/or additional charges total exceed the amount of the Security damage deposit, the guest is responsible for the exceeded amount. Guest agrees and acknowledges that the credit card on file will be charged to settle the exceeded amount. Cleaning, replacement and/or repaired items will be charged at the fair market price.  Claims may take up to 60 days to be processed. In rare occasions the claim processing time may take longer, based on the type of claim. Should the Agent be unable to collect the outstanding balance on the credit card on file, payment should be sent to our office upon receipt of the claim.

If the rental unit is left generally in the same condition as unit was at arrival, except for normal wear and tear, your Security damage deposit will be refunded within 15 days from your departure date.

CANCELLATION POLICY: A written cancellation notice must be received 60 days prior to the commencement of your reservation period. All cancellations will incur a $75.00 cancellation fee charged against your RESERVATION DEPOSIT. Any rental fee paid in advance will be refunded.  The ADMINISTRATIVE FEE (based on 3% of the total rental rate) is NOT REFUNDABLE.

Reservation cancellations with less than 60 days to arrival date; a $75.00 cancellation fee will be charged against your RESERVATION DEPOSIT and the balance and all advanced rent moneys will be held for forfeiture to the owner of the rental unit. The amount of forfeiture will be calculated by the number of days the unit was not re-rented during the full number of days of your original reservation.

REFUNDS: No refunds will be granted for inclement weather or early departures.

CLEANING: A DEPARTURE CLEANING FEE plus TAXES payment is due upon arrival. All rental units have been professionally cleaned. Any cleaning issues should be reported to our office within 24 hours of your arrival date.  At departure, renter should leave unit in generally as clean of a condition as unit was at arrival.  At departure guest may leave two (2) loads of laundry (this is primarily one set of bed linen from each bed and a moderate amount of bath and dish towels.)

Guest is responsible for cleaning the unit during the time of occupancy. Should the guest leave more than the allowed loads of laundry, dirty dishes, and/or an overly dirty apartment; a $35.00 per hour (maximum 4 hours) will be charged against your security damage deposit. The cleaning of excessive soil to carpets and/or furnishings will be charged against your security damage deposit.

PAYMENT POLICY: All payments must be made in US funds. Deposits, Fees and taxes are due as scheduled on your reservation confirmation.

Initial Reservation Deposit and Non-Refundable Administrative Fee payment by Visa, MC or Discover card is required at the time of reservation. Agent approval is required at the time of reservation to make the initial Reservation Deposit and Non-Refundable Administrative Fee payment by personal check, money order or certified bank and payment must be received within 7 days from reservation date.

Upon arrival a Security damage deposit of $500.00 paid by Visa, MC or Discover card is required.

– A 50% deposit of the rental fee and taxes is due 60 days prior to arrival date -payment by check is required- for reservations during High-Season (February-April). Balance on the rental fee and taxes plus cleaning fee and security damage deposit will be due upon arrival. Reservations during the Off-Season rental fee and tax balance plus cleaning fee and security damage deposit is due upon arrival (unless noted differently on your reservation confirmation).

Rental fee, taxes, cleaning fee and security damage deposit due on arrival, payments by Visa, MC or Discover credit cards are accepted when the credit card holder (owner) and credit card are present at the time of the transaction. Cash and traveler’s check payments are accepted in person only.

If you are a late, Sunday or holiday arrival, please come to the office to settle your account by no later than 12:00 PM on the following business day from your arrival date.

SUBSTITUTION OF ACCOMMODATIONS:  Agent reserves the right to substitute like and suitable accommodations at any time during the reservation if circumstances so require. Rental rates are subject to change without notice.

CHECK-IN / CHECK-OUT: Check-In time is after 4:00 PM on reservation beginning date, please review your reservation confirmation package for instructions on how to obtain a condo key if you are a late or Sunday arrival. Check-Out is 10:00 AM. No exceptions! Guest and guest’s entire party must vacate the property and return the keys to the office or to the lock box not later than 10:00 am. Failure to check out on time may result in an additional one-night charge and loss of rent penalties.

OFFICE HOURS: – Monday thru Friday 9:00 AM to 5:00 PM  –  Saturday: 10:00AM to 5:00 PM  –  CLOSED on Sunday

KEYS / LOCK OUTS: Keep you unit key with you at all times, the entry door to all condos locks automatically when the doors are pulled shut. Up to two (2) sets of keys are issued at arrival check-in. In the event the guest locks her/himself out of a unit after hours, it will be necessary to call the emergency phone number located by the lock box at the front door of the office. There will be a $35.00 fee charge for after-hours lock out. In the event a key set is lost or not-return, the door lock may be replaced. The door lock replacement cost will be charged to your rental account.

PARKING:  Each unit is provided with one assigned parking space under the building marked with unit number. Maximum vehicle height for parking under the building is 6 (six) feet.  All vehicles must register in the office during office hours to obtain a parking permit. Larger vehicles, vans, or large SUV’s may park in the visitor parking spaces in the front lot by the office. Visitor Parking Lot spaces are available as first come first serve basis. Parking along the driveway around the building is prohibited… Parking permit must be display in the vehicle’s rear view mirror. Vehicles not displaying a parking permit or parked inappropriately may be towed immediately without notice at the vehicle owner’s expense. Watch your speed and exercise caution at all times.  Speed Limit is 5 MPH.…

UNIT AMENITIES / FURNISHINGS / UTILITIES: All units include furnishings required for normal living conditions, adequate supply of linens and towels, adequate supply of dinnerware, silverware, glassware and cooking utensils. Kitchens are furnished with oven/stove, refrigerator, sink, dishwasher, microwave and adequate cabinet storage. All units have, central air conditioning, patios, colored cable TV and telephone (local calls only). Guest is responsible for excessive use of electricity. In the event furniture is moved by the guest or guest’s visitors, additional fees will be charge to place furniture in the original place. Not included with unit rental: paper products, trash bags, dish or laundry soaps or any other day to day consumable living or cleaning products. Daily linen service is not provided. Coin operated laundry facilities are located on each floor by the elevator. You may call the office and request additional fresh linens for an additional fee. If you desire additional cleaning services during your stay, you may contact the office to assist you with arrangements. Additional fees will apply.

REPAIRS: We try to keep all units in good working order, however we cannot guarantee against any malfunction. Should a failure occur we will do our best to have the malfunction repaired as soon as possible. There will be no refund given due to malfunction or failure of any unit furnishings or appliances including air conditioning units.

Any damages to the unit and/or furnishings must be immediately reported. Failure to notify rental office within 24 hours or arrival (excluding Sundays and holidays – in which case guest must report the problem to the office on the following business day) of any missing or inoperative furnishings or equipment or any weak or unsafe conditions will result in responsibility resting with guest. Occupancy by you and your party shall be conclusive evidence that the unit is in satisfactory condition. During your stay, please promptly report any problems with the unit or its furnishings to the rental office so that the situation may be addressed and corrected as needed. The Agent, authorized employees or repairman (who must sign in at the Sea Shell office) may enter the unit, with or without permission of the guest, during regular business hours, for any purpose connected with the repair of the unit components or common property. In case of emergency, the Agent or its assignee may enter at any time with or without notifying to the guest.

TERMINATION OF RENTAL: If the guest or guest’s visitors violate any of the conditions or restrictions of the Agreement, Agent reserves the right to immediately terminate this Agreement and all unit occupants shall vacate the premises immediately. No refunds, including unused rental amounts will be returned. Sea Shell Vacation Rentals and/or Sea Shell Condominium Association, Inc. reserve the Right to Evict where Guest refuses to comply with Association covenants or rules and regulations.

LIABILITY: Sea Shell Vacation Rentals, Inc. as agent, its assignee, employees, or the owner of the individual unit rented, shall not be liable for any damages or injury to guest or to any other person, or damage to any property occurring on the premises or any part thereof, or in common areas thereof, and guest agrees to hold agent, agent assignee, agent employees and owner harmless for any claims for damages, no matter how caused. Agent will not be held responsible for acts of theft, vandalism or other damage to guest’s personal property or vehicle.

NON-EMERGENCY AFTER HOURS CALLS: After normal office hour’s maintenance service is available for emergency situations only, i.e. plumbing leaks, power failure etc. Should maintenance be called and respond to a situation that is deemed to be a non-emergency there will be a charge of $35.00 per call.

LOCKED CLOSETS OR CABINETS: Some unit owners have personal property locked in closets or cabinets. These areas are not included in the unit rental and are not to be tampered with.

MAXIMUM OCCUPANCY OF RENTAL UNITS: The maximum occupancy of our rental units is (6) six persons. Some units can only accommodate a maximum occupancy of (4) four or (5) five persons. Rates apply to 4 (four) person per unit. Extra person charge $15.00 per person per day. No additional persons may occupy the unit other than those approved by and registered at the rental office. If additional or unregistered persons are discovered occupying a unit the registered guest and their party will be evicted from the unit property.

AFTER HOURS ARRIVAL: After hours the keys to your condo and the car permit will be in the lock box located by the office door. The combination to open the lock box is C1492. To open the lock, push button C, then push the four-digit number. Turn the knob to the left and pull open. Your key will be in an envelope noted with your Name and Unit number. Please close the lock box securely after removing your keys. To enter the gated area of the grounds you must enter the gate code into the key pad located just in front of the gate. Our gate code changes every year in May. The current gate code will be posted on the check-in package located either in the office or the lockbox.

RADON GAS (STATE REQUIRED DISCLOSURE): RADON is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.  Levels of radon that exceed Federal and State guidelines have been found in Florida.  Additional information regarding radon and radon testing may be obtained from your County Public Health Unit.

DISCLAIMER: Guest agrees to be bound by all terms and conditions of the Sea Shell Declaration of Condominium governing the Premises and by any rule and regulation heretofore or hereafter adopted by the Association. By accepting this Rental Agreement as the guest, you agree to be responsible for any damage(s) to the unit, dwelling, furnishings, grounds or common area which occur through acts of negligence of or by you, your family, friends or social guests. Guest agrees to surrender the property at the time and date specified in as good condition as it was at the beginning of your stay, except for reasonable wear, act of God, and/or causes over which you have no control. If the unit is not left in satisfactory condition, you will be charged for repair and restoration to satisfactory condition, plus lost rent time. Guest agrees to pay a reasonable attorney fee and all court costs and expenses to enforce this agreement including appellate proceeds with or without legal proceedings.

Absolutely NO PETS, NON-SMOKING, No roller blades, skate boards, commercial trucks, trailers, campers, motorcycles, scooters, boats or commercial vehicles are allowed in the property. No FIREWORKS are permitted on premises. Guest may not sublet the unit at any time. Guest CERTIFIES that he/she has read carefully and understands the limitations on a rental unit as set forth in this Lease Agreement. Guest ALSO CERTIFIES that he/she understands the limitations on the number of persons permitted to occupy a unit and the applicable fees. Guest fully agrees to abide by all such limitations.
